HABANA GOLD TM REGISTRATION CANCELLED


The owner of the HABANA GOLD trademark registration failed to file a response in opposition to Corporacion Habanos’ Motion for Sanctions.   The failure to file a response resulted in a concession of all arguments raised therein. Based upon this, the Trademark Trial and Appeal Board granted the relief requested by Corporacion Habanos and cancelled the trademark registration.  This is unfortunate and could have been avoided. However, it’s not my fight or my trademark … so be it. Another trademark falls in the Corporacion Habanos DEAD POOL.

Pernod Ricard Files Request for Ext. Time to Oppose HAVANA MOJITO



Havana Cola has been around for a while. A few months ago, they filed a trademark application for “HAVANA MOJITO”. The trademark sailed through the trademark office and was published for opposition. Fearing that the mark would soon register, Pernod Ricard USA and it’s Cuban friend Empresa Cubana Exportadora de Alimentos y Productos Varios d/b/a CubaExport, filed the opposition. You might recall those two names, Pernod Ricard and CubaExport. They are the enties that fought, and lost (arguably still ongoing litigation) the HAVANA CLUB mark against Bacardi.

Here’s an idea. Spend your money on something that really, really, really matters. What the F**K difference does it make if HAVANA MOJITO becomes registered, or not. CubaExport: I’m speaking directly to you “don’t let those folks talk you into this nonsense litigation.” Oh, that’s right, you’re an entity owned and controlled by a communist country that happens to join up with foreign companies that want to control your rum and cigar businesses before the embargo is lifted so that they will control the exportation of those products in the United States before others can get in where they fit in. (Fat Boy Slim is playing in the background, thus, the rant.).
